Ohio DUI Laws – 1st Offense

First offense results in a driver’s license suspension from 6 months to 3 years, fines from $250-$1,000,  and jail term from 3 days (6 days with BAC .17% or greater) to six months.  A license reinstatement fee of $450 will also be assessed.

Ohio DUI Laws – 2nd Offense

Second offense results in a driver’s license suspension from 1 to 5 years, fines from $350-$1,500,  and jail term of 10 days minimum (20 days with BAC .17% or greater).  A license reinstatement fee of $450 will also be assessed.  Electronic home monitoring is required for 18 days to 6 months.  Vehicle immobilization for 90 days and a Driver Intervention Program will ordered by the court.

Ohio DUI Laws – 3rd Offense

Third offense results in a driver’s license suspension from 1 to 10 years, fines from $350-$1,500, and jail term of 30 days (60 days with BAC .17% or greater) to 1 year.  15 days of jail plus 55 days to 1 year of Electronic Home Monitoring may be ordered in lieu of straight jail time.  A license reinstatement fee of $450 will also be assessed.  Vehicle immobilization for 180 days and an Alcohol Treatment Program will ordered by the court.

Ohio DUI Laws – 4th Offense

Fourth offense is considered a Felony and results in a driver’s license suspension from 3 years to life, fines from $800-$10,000, and jail term of 60 days to 1 year.   A license reinstatement fee of $450 will also be assessed.  Vehicle forfeiture is mandatory and an Alcohol Treatment Program will ordered by the court.

Ohio DUI Laws – Implied Consent Laws

Anyone driving a vehicle in Ohio has given implied consent to submit to a BAC test.  First refusal results in an automatic 1 year license suspension.  Second refusal results in a 2 year suspension.  Third refusal results in a 3 year suspension.  Fourth refusal results in a 5 year suspension.

 

Ohio DUI Laws – “Per se” BAC Level

The per se BAC level in Ohio is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.

 

Ohio DUI Laws – “Zero Tolerance” BAC Level

The zero tolerance BAC level in Ohio is .o2%.  Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.

 

Ohio DUI Laws – “Enhanced Penalty” BAC Level

There are enhanced penalties in Ohio at a BAC of .17% or greater that increase minimum  jail time in some cases.
