First offense results in a driver’s license suspension from 90-365 days, fines up to $2,000 (up to $10,000 with child under 15 in vehicle), and jail term from 72 hours to 180 days (180 days to 2 years with child under 15 in vehicle). A DWI surcharge of $1,000 ($2,000 for BAC .16 or greater) will be applied for 3 years.
Texas DUI Laws – 2nd Offense
Second offense results in a driver’s license suspension from 180 days to 2 years, fines up to $4,000 (up to $10,000 with child under 15 in vehicle), and jail term from 30 days to 1 year (180 days to 2 years with child under 15 in vehicle). A DWI surcharge of $1,500 ($2,000 for BAC .16 or greater) will be applied for 3 years. An Ignition Interlock device will be ordered by the court.
