Wyoming DUI Laws – 1st Offense
First offense results in a driver’s license suspension for 90 days. Also fines up to $750 and/or a jail term of up to 6 months. A substance abuse assessment will be ordered. An Ignition Interlock device is required for offenders with a BAC .15% or greater.
Wyoming DUI Laws – 2nd Offense
Second offense results in a driver’s license suspension for 1 year, fines from $250 to $750, and a jail term from 7 days to 6 months. A substance abuse assessment will be ordered. An Ignition Interlock device is required for 1 year.
Wyoming DUI Laws – 3rd Offense
Third offense results in a driver’s license suspension for 3 years, fines from $750 to $3,000, and a jail term from 30 days to 6 months. A substance abuse assessment will be ordered. An Ignition Interlock device is required for 3 years. Court may also order Probation, an Inpatient Treatment Program and/or an Alcohol Education Program.
Wyoming DUI Laws – 4th Offense
Fourth offense is considered a Felony and results in a driver’s license suspension of up to life, fines up to $10,000, and a jail term for up to two years. An Ignition Interlock device is required for life. Court may also order Probation, Substance Abuse Assessment, an Inpatient Treatment Program and/or an Alcohol Education Program.
Wyoming DUI Laws – Implied Consent Laws
Anyone driving a vehicle in Wyoming has given implied consent to submit to a BAC test. First refusal results in a 6 month license suspension. Subsequent refusals result in an 18 month suspension.
Wyoming DUI Laws – “Per se” BAC Level
The per se BAC level in Wyoming is .08% meaning anyone driving a vehicle with a BAC of .o8% or over can be charged with dui regardless of driving performance.
Wyoming DUI Laws – “Zero Tolerance” BAC Level
The zero tolerance BAC level in Wyoming is .o2%. Anyone under the age of 21 driving with a BAC of .02% or greater can be charged with DUI.
Wyoming DUI Laws – “Enhanced Penalty” BAC Level
There are no enhanced penalties enforced in Wyoming.
